Senate GOP Must OBJECT, OBSTRUCT & DELAY – AGAIN!
It is time to bring the Senate to a SCREECHING HALT!
There are now three possible legislative outcomes on healthcare, which are listed below in descending order of probability:
2. The House passes the Senate bill and that bill is signed into law by the president without any kind of Reconciliation “fix;” or 3. The Senate bill is killed in the House and the assault on America’s healthcare system is done for this Congress. As we have pointed out many times before, both outcomes one and two above will lead to a federally subsidized system of abortion on demand. Only outcome number three can prevent the creation of a federally subsidized abortion mill, not to mention preventing the host of other abominations in the bill that will change America’s political and economic systems for the worse on a scale not witnessed since the New Deal. Senate GOP Must OBJECT, OBSTRUCT & DELAY – AGAIN! While the war against government-run health care wages on, Republicans are fighting the good fight. But are they fighting the right fight? Republicans are blasting Obama and the Democrats yet that simply is not enough to bring health care reform to a screeching halt. Republicans must ask themselves: What can we do that will change the entire political landscape and effectively kill ObamaCare in this Congress? The answer is to shut down the entire Senate using every procedural device at Republican Senators command until the Democratic Leadership agrees to MOVE ON—moves off healthcare without passing a Reconciliation Bill and stay off healthcare until the 112th Congress convenes next year. One never knows how a legislative body will vote until the votes are tabulated; anyone who says otherwise hasn’t spent enough time around elected representatives to understand their quirky behavior. Elected representatives are like quantum particles: they live in a state of quantum uncertainty until their vote is cast and is observed on the tally sheet. Reminiscent of Schrodinger's Cat, Congress Critters exist in a state of quantum superposition, in which all possibilities exist until the superposition “collapses” at the instance of measurement, i.e. when the vote is cast and recorded. Elected representatives lead a dual (superimposed) existence before they vote: both wise trustee and robotic delegate, both statesman unwavering on principle and political hack for sale. Until they vote, one can only predict their behavior probabilistically. Senate GOP Must OBJECT, OBSTRUCT & DELAY – AGAIN!
While the probability of outcome number three above occurring is getting smaller everyday, there remains a non-trivial chance that the ObamaCare Cat will turn up dead when the votes finally go up on the wall in the House. But, here is the dilemma for opponents of ObamaCare: It is up to the Senate (specifically Senate Republicans) to kill its own bill in the House. Now is the time for Republican Senators to put country above career and do whatever is necessary to convince wavering Democrats in the House that if they vote for the Senate Bill—or allow the Senate Bill to be deemed passed in the House through legislative trickery lead by Speaker Pelosi—they will be hung out to dry in the Senate because the Senate won’t come to their rescue with Reconciliation.

However, Senate Republicans can’t wait to carry out their threat on a Reconciliation bill until after the House acts on the Senate bill; it will be too late then. Senate Republicans must act NOW to send House Democrats an unequivocal message: All 41 Senate Republicans will do everything necessary to defeat ObamaCare up to and including shutting down the entire Senate until the Democratic Leadership agrees to MOVE ON—move off healthcare without passing a Reconciliation Bill and stay off healthcare until the 112th Congress convenes next year. With no chance of a Reconciliation bill in the Senate the likelihood that 216 Democrats will vote for the Senate bill in the House plummets. THANKS TO YOUR FAXES - Senate Republicans were successful in delaying ObamaCare in December. Thereafter, Republican Scott Brown was voted into the Senate. Scott Brown’s victory in Massachusetts taking Senator Ted Kennedy’s U.S. Senate seat was a clear referendum on Obama’s health care reform. The people spoke loud and clear. The people said NO to government intervention, the people said NO to socialism, and the people said NO to ObamaCare! SENATOR JIM DEMINT KNOWS THIS IS THE ONLY WAY TO DEFEAT OBAMACARE – Rep Paul Ryan “Gets It” too.

Now is the time for Republicans to work fearlessly and fervently, using every tool in their war chest to wage war against this government take-over of health care. Now is the time for Senate Republicans do everything they can to stop this toxic health care reform bill from being passed. Now is the time to stop ObamaCare dead in its tracks before it runs the United States off the rails, destroying American families and businesses. What Must Senate Republicans do? Barricade ObamaCare. Senate Republicans must adopt a preemptive strategy and use every tool at their disposal to shut the Senate down, NOW. Obstruct ObamaCare. Senate Republicans must SHUT DOWN the Senate using tactics such as amendment objection, points-of-order and vote-a-rammas. DENY ObamaCare. Senate Republicans must hold House Democrats feet to the fire. They must force House Democrats to vote yes or no on health care legislation, which includes abortion funding. Any Democrat facing reelection will be judged in November on Election Day. House Democrats MUST understand that Senate Republicans will kill any attempt at a reconciliation bill.

The dilemma is how to send this message persuasively before the fact because by the time arrives for Republicans to carry through on their threat to stop Reconciliation, it will be too late; the very fact of a live Reconciliation bill in the Senate to defeat means the House bill already will have escaped the House and be on the way to the President for his signature. Defeating Reconciliation in the Senate, therefore, is like tearing down the barn after the fox has eaten the chickens and escaped. The time to tear down the barn is while the fox is still inside and can be destroyed in the controlled demolition. Every day that Senate Republicans wait to take action, the closer the day approaches that Speaker Pelosi will buy and intimidate the 216 votes she needs to pass the Senate bill in the House. If the Senate bill passes the House, it will be because Senate Republicans failed to convince House Democrats the GOP would pay any political price, make any political sacrifice to save the country from ObamaCare. Some faint-hearted Republicans protest that a Senate shut-down strategy is just what the President and his Pelosi and Boxer Democrats want. If Republicans shut down the Senate, they claim, they will be pilloried as “the party of no;” on top of which a Senate shut-down would allow the Senate Bill to be enacted into law without any cosmetic reconciliation “fixes,” precisely what Senate liberals and the president desire. SENATOR JIM DEMINT KNOWS THIS IS THE ONLY WAY TO DEFEAT OBAMACARE – Rep Paul Ryan “Gets It” too. This excuse fails to be persuasive on two fronts. First, “cosmetic” is the operative word. It makes little difference which version of ObamaCare is enacted. The Speaker of the House already has said no matter which version is enacted into law this year it will represent merely a foot in the door for future expansions of the government’s control of healthcare. Therefore, an unadulterated Senate bill is hardly worse than the “reconciliation-repaired” version congressional Democrats are talking about. If risking the Senate bill’s enactment into law is what must occur to have a realistic chance of killing ObamaCare before it escapes the House, that is a risk worth taking. Second, an unadulterated Senate bill can be enacted into law only if it is first voted out of the House in tact. There is a high probability that will happen unless Senate Republicans act right NOW to make it perfectly clear to House Democrats that they are serious about defeating ANY Reconciliation Bill in the Senate. Republicans must convince House Democrats BEFORE they are asked to cast their “yea” vote for the Senate Bill or the Slaughter Proxy that if they do in fact vote “yea” there will be no do-over reconciliation “repair job” coming out of the Senate, in which case House Democrats will be responsible for enacting the unadulterated Senate bill into law if they vote it out of the House.

Think of it as a game of chicken in which one driver (Senate Republicans) yanks the steering wheel off the steering column—making it impossible to veer away from a head-on collision at the last instant—and drops it out the window of the speeding car in full view of the other driver. Seeing that irrevocable commitment by the seemingly irrational driver bearing down on him, the driver with his steering wheel still firmly attached (House Democrats) has only once choice: swerve or die. One can’t say for sure but there is a good chance that if Senate Republicans jerked the steering wheel off the steering column and irrevocably committed itself to crashing head on into any Reconciliation Bill barreling at them through the Senate enough skittish House Democrats would get the message and swerve from disaster by voting “no” on the Senate Bill or any devious Slaughter Proxy Speaker Pelosi dreams up. In my discussions with Senate insiders, I am told Senate Republicans feel they can stymie a Reconciliation measure through a combination of points of order and a steadfast commitment to exploit the so-called vote-a-rama opportunity for all it is worth. For example, all 41 Senate Republicans have signed a letter pledging to vote to uphold all points of order brought against a Reconciliation Bill in the Senate. Moreover, according to former Senate Parliamentarian Bob Dove, Republicans could offer as many amendments during vote-a-rama (after the 20-hour period of debate under Reconciliation expires) as they can write and thereby tie up the Senate indefinitely. Taken together then the points-of-order and vote-a-rama strategies might be likened to loosening the screws on the Senate steering wheel without actually pulling it off and dropping it out the window. Hence, both strategies are still safe, halfway measures insufficiently immutable to put the fear of God into House Democrats. What Senate Republicans lack to kill the Senate bill in the House is a persuasive means of convincing House Democrats BEFORE THE FACT that GOP Senators are serious in their resolve to kill any Reconciliation bill. Their own reputation of timidity haunts Republicans. Frequently in the past when the opportunity to obstruct and defeat bad legislation presented itself under vote-a-rama, Republicans allowed themselves to be browbeaten and caved in the name of comity and cooperation. That is why Republicans must adopt a preemptive strategy and use every parliamentary device at their disposal to shut the Senate down, NOW. The signers of the American Declaration of Independence pledged their lives, their fortunes and their sacred honor for liberty. Is it too much to ask present day Senators to pledge their Senate seats to prevent the further erosion of individual liberty, personal privacy and economic freedom?
